Terms & Conditions
1. This contract is between Leoda Studios (hereinafter known as the Photographer) and the Clients (hereinafter known as the Couple).
2. It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
3. This contract for wedding photography services is effective from the date it is signed by the couple.
4. The photographer will only deal with matters concerning the contract or booking with the couple.
5. The photographer agrees to be in attendance on the date shown and to provide the couple with the photographic package shown above.
6. If the photographer is unable to attend the wedding due to illness or any other unforeseen circumstances preventing his attendance a suitable replacement photographer will be provided by the photographer.
7. The photographer agrees that the above price will not be subject to any subsequent rises within the Leoda Studios pricing structure.
8. The couple agree to pay a 20% deposit to secure their desired date and understand that in any event of cancellation this deposit is 100% refund will be done if informed prior 14 days of actual wedding date. 50% refund will be done if informed prior 7-14 days of actual wedding date. No refund is applicable if cancellation done within 7 days of actual wedding date
9. The couple agree to pay the full remaining balance of the photography package purchased at least on the wedding date.
10. The photographer agrees that every effort will be made to provide the highest quality photographic services in the prevailing conditions.
11. The photographer will discuss a shot list with the couple prior to the wedding to outline the normal shooting plan at every wedding. The photographer will also ask the couple to provide a list of family photographs they request to have taken on the wedding. If no list is provided the photographer will capture as many family shots as possible in the time frame given but cannot be held accountable by the couple for family shots missed due to the couple not providing a list regardless of how simple.
12. In the unlikely event of total or part photographic failure, equipment failure, hard drive failure, memory card failure, theft, death, injury or illness, accident or other unforeseen circumstances beyond the photographers control, the photographers liability shall be limited to a full refund of all moneys paid and the photographer shall not be responsible for other consequential damages, emotional or otherwise.
13. The photographer retains the copyright of all images taken and may be used for advertising, competitions or promotional purposes at the photographers discretion. The photographer also retains the right to restrict the couple from giving the images to any third party for advertising without permission from the photographer.
14. No one other than the photographer is permitted to edit any photographs provided by the photographer unless the photographer grants permission.
15. The couple will receive the best images from the wedding, selected by the photographer and edited to a professional standard, the couple will not receive every photograph taken on the day and the couple will not receive RAW files or negatives.
16. In booking the photographer, you have taken into consideration the photographers style and are granting artistic license in all aspects relating to the photography of your wedding.
17. For pre-wedding and post wedding outdoor shoots Travel and food expenses charges have to be provide to the photographer excluding the Package rate.
18. The photographer will give suggestions for location photographs if requested by the couple but will not be liable for the guarantee of the use of the location nor the conditions of the location including any charges
19. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
20. The photographer is the only authorised and official photographer for your wedding day. The earliest the photographer will work on any wedding day is two hours before the ceremony and the latest shall be 9.00pm. A hot meal for the photographer must be provided if evening coverage is requested.
21.The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
22. The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
23. Couple will be given the maximum timeline of 1 month from the wedding date to decide on the post wedding shot date and location. Also the couple has to give the notice date, a week prior to the actual date of post wedding shoot.
